    Parental Leave Policy

    California Family Rights Act (CFRA)
Eligible employees can take up to 12 weeks of unpaid, job-protected leave to bond with a new child (birth, adoption, or foster care) within the first 12 months.
This means you must be reinstated to the same or a comparable job when you return.
Federal Family and Medical Leave Act (FMLA)
Similar to CFRA, FMLA also allows up to 12 weeks of unpaid, job-protected leave for parental bonding for qualifying employees of larger employers (50+ employees).
CFRA and FMLA often run at the same time if the employer is covered by both.
    Eligibility (generally)
To use CFRA/FMLA leave your employer must meet size thresholds and you must:
    Have worked there ≥12 months,
Have worked at least 1,250 hours in the past year,
Work for an employer with 5+ employees (for CFRA) or 50+ (for FMLA).
Important: Neither CFRA nor FMLA guarantees paid leave — they protect your job while you take unpaid time off.
State Wage Replacement Benefits (Paid Family Leave, PFL)
California has a Paid Family Leave (PFL) program administered by the Employment Development Department (EDD):
Up to 8 weeks of partial wage replacement benefits in a 12-month period for time off to bond with a new child (or care for a seriously ill family member).
PFL is paid through state disability insurance (SDI) contributions you already make through payroll. (Employment Development Department).
It pays you but does not itself guarantee job protection — job security must come from CFRA, FMLA, or an employer’s own policy.
The weekly benefit amount is a percentage of your earnings (varies by income and year).
